Privacy Policy

Introduction

Privacy of personal information is an important principle to Dr Foot Clinic, located at 6464 Yonge St, Unit 161A, North York, ON, M2M 3X4. We are committed to collecting, using, and disclosing personal information responsibly and only to the extent necessary for the services we provide. We strive to be open and transparent about how we handle personal information.

What is Personal Information?

Personal information is any factual or subjective information, recorded or not, about an identifiable individual. Personal information includes data related to personal characteristics (e.g., gender, age, income, home address, phone number, ethnic background, family status), and health (e.g., health history, health conditions, health services received). Personal information is distinct from business information (e.g., business address and phone number), which is not protected by privacy legislation.

What is Personal Health Information?

In Ontario, personal health information is covered under the Personal Health Information Protection Act (PHIPA). Personal health information includes any data that identifies an individual and relates to their physical or mental condition, health care history, provider of health services, payment for health services, health card number, substitute decision-maker, or any non-health care information mixed with personal health information.

Who We Are

Dr Foot Clinic is a rehabilitation clinic providing various health services. Our team includes registered podiatrists, physiotherapists, chiropractors, massage therapists, osteopath, naturopath, acupuncturist, office managers, and administrative support staff. We also engage consultants and agencies that may have limited access to personal information during their duties. These include IT consultants, office security and maintenance personnel, volunteers, co-op students, bookkeepers, accountants, temporary workers, credit card/merchant terminal service providers, cleaners, and lawyers. We restrict their access to personal information as much as possible and require their assurance that they follow appropriate privacy principles.

Why We Collect Personal Information: Primary Purposes

About Clients

We collect, use, and disclose personal information to serve our clients effectively. For clients, the primary purpose for collecting personal information is to provide services. For example, we collect health history, family history, physical condition, and social situation to assess health needs, advise on options, and provide chosen health care. We also establish a baseline of health and social information for ongoing health services to identify changes over time. In rare cases, we may collect information without explicit consent in emergencies or when it's impractical to obtain consent.

About Members of the General Public

For members of the public, we collect personal information to notify them of special events or services. We might collect home addresses, fax numbers, and email addresses, aiming to obtain consent before using any such personal information. Upon request, we will remove any personal information from our distribution list.

About Contract Staff, Volunteers, and Students

For contractors, volunteers, and students, the primary purpose of collecting personal information is to ensure future contact, work-related communication, and emergency response. Examples include home addresses and telephone numbers. Information may also be collected to investigate potential legal breaches.

Why We Collect Personal Information: Related and Secondary Purposes

We collect, use, and disclose information for purposes related to or secondary to our primary purposes. Examples include:

Invoicing clients, processing payments, and collecting unpaid accounts.

Advising clients on product/service reviews and new opportunities.

Conducting quality assurance reviews and audits.

Complying with regulatory inspections and reporting serious misconduct or illegal activities.

Demonstrating client entitlement to third-party funding for services.

Protecting Personal Information

We understand the importance of protecting personal information. Measures include:

Supervising or securing paper information in locked areas.

Securing electronic hardware and using passwords on computers.

Using digital cell phones to protect signals from interception.

Transmitting paper information through sealed, addressed envelopes or boxes.

Transmitting electronic information through direct lines or encryption.

Backing up electronic medical records on secure cloud services.

Training staff to handle personal information responsibly.

Ensuring external consultants and agencies sign privacy agreements.

We avoid initiating transmission of personal information via email unless specifically requested by the client. For concerns about information interception, we recommend contacting us by phone or other secure methods.

Retention and Destruction of Personal Information

We retain personal information to answer any questions about services provided and to meet accountability standards of regulatory bodies. We keep client files for about 10 years from the last entry (or 10 years past age 18 if the client was under 18). We destroy paper files by shredding and delete electronic information, ensuring hardware is physically destroyed when discarded.

Accessing Your Information

You have the right to see the personal information we hold about you. We will help you identify and understand the records we have. We may charge a nominal fee for access requests and will respond within 30 days. If we cannot provide access, we will explain why. You can request corrections to factual information and include a brief statement in our file if we disagree with a correction.
